The Law of Capture - Oil and Gas Law

A landowner may capture oil and gas operations on his own land, assuming he owns the mineral rights to the land and the oil and gas beneath his land. Once he captures the oil and gas he absolutely owns it, and it is reduced to his dominion and control. However, the right to capture and control it is subject to the possibility of capture and control by another acting within his own rights as landowner from a common source of supply. The owner of the drained tract has no legal remedy but many protect his rights by drilling his tract and capturing first.
