What Is a Class B Misdemeanor?
The smallest possible charge of drug possession would be considered a Class B misdemeanor, which could get you up to 180 days in jail or a fine of no more than $10,000 for possession of two ounces or less of marijuana (specifically).
However, the penalties go up depending on:
- How much of the drug you had
- What type of drug it was
- How the drug was stored or concealed
- Possession of additional drug paraphernalia
- And any past convictions
What Is a Class A Misdemeanor?
A Class A misdemeanor would lead to a penalty of up to a year in jail and/or a fine of no more than $4,000, depending on the type of drug. Possession of a drug such as cocaine or heroin could lead to a conviction of a third- to a first-degree felony. The highest penalty possible for drug possession is 99 years in prison and a fine of up to $250,000.
